Nonpayment of Rent
The first thing a landlord must do is send to the tenant(s) form DC100a. The instructions and requirements for delivery are listed on the first page of the form. This is a 7 day notice informing the tenant(s) of a 7 day time limit to pay rent or vacate the property. If, after 7 days have passed, and the tenant(s) have not paid rent or vacated, the landlord may submit to the court a copy of the DC100a that was delivered, as well as four copies each of the complaint form (DC102a) and the court summons (DC104). The landlord must also submit four copies of the lease.
Health Hazard or Physical Damage to Property or Person
The first thing a landlord must do is send to the tenant(s) form DC100b. The instructions and requirements for delivery are listed on the first page of the form. This is a 7 day notice informing the tenant(s) of a 7 day time limit to remedy the hazard or damage, or vacate the property. If, after 7 days have passed, and the tenant(s) have not remedied or vacated, the landlord may submit to the court a copy of the DC100b that was delivered, as well as four copies each of the complaint form (DC102b) and the court summons (DC104). The landlord must also submit four copies of the lease.
Illegal Drug Activity
The first thing a landlord must do is file a formal police report alleging illegal drug activity on the premises. The landlord must then deliver to the tenant(s) form DC100e. The instructions and requirements for delivery are listed on the first page of the form. This is a 24 hour notice informing the tenant(s) of a 24 hour time limit to vacate the property. If, after 24 hours have passed, and the tenant(s) have not vacated, the landlord may submit to the court a complaint and summons. Check with the county court clerk for the forms pertaining to Illegal Drug Activity, as they are not found online at this time.
Lease Violations, Hold Overs, All Other Evictions
The first thing a landlord must do is send to the tenant(s) form DC100c. The instructions and requirements for delivery are listed on the first page of the form. This is a 30 day notice informing the tenant(s) of a 30 day time limit vacate the property. If, after 30 days have passed, and the tenant(s) have not vacated, the landlord may submit to the court a copy of the DC100c that was delivered, as well as four copies each of the complaint form (DC102c) and the court summons (DC104). The landlord must also submit four copies of the lease.
